The purpose of these General Terms and Conditions of Sale to individuals is to regulate the marketing throughout the European Union and the United Kingdom of the products offered by MK FOOD & BEVERAGES, SLU. to its private customers (hereinafter referred to as the Client(s) through the https://momkoumba.com/ Website (hereinafter referred to as the Website).
These General Terms and Conditions of Sale are applicable exclusively to private customers and, in no case, to entrepreneurs and professionals who do not have the status of “final consumer”.
MK FOOD & BEVERAGES, SLU. reserves the right to modify at any time the contents, services or products marketed from the Website, as well as the commercial offers presented.
The Client declares to be aware that, when purchasing products on this Website, they have read and accepted the Legal Notice, the Conditions of Use and the Privacy Policy (published at the bottom of the Website), as well as these General Conditions of Sale. In this sense, the User must comply with the rules and obligations established therein.
The descriptions of the products that appear on this website correspond to the actual products offered for sale, with the aim of providing the most truthful and accurate information possible about them and their characteristics. However, the customer should be aware that this information is not exhaustive.
The price and minimum purchase quantity of each item are as stated on this website.
The prices of the products displayed on this website, as far as individual customers are concerned, include VAT (Value Added Tax).
Shipping costs: The prices indicated on this website do not include shipping and handling costs. For orders under €30 the following will be charged:
- Peninsula: 5 €
- Balearic and Canary Islands: 10 €
- Ceuta and Melilla: 15 €
- Europe: 15 €
Orders sent to the peninsula with an amount greater than € 30 will have free shipping.
MK FOOD & BEVERAGES, SLU reserves the right to modify prices at any time, without affecting orders already confirmed before the price change. The prices published on this website will be valid from the day of their publication.
All orders are subject to the express acceptance of the General Conditions of Sale by the Client and to the confirmation of the purchase by MK FOOD & BEVERAGES, SLU by sending an email.
MK FOOD & BEVERAGES, SLU will make every effort to meet the demand of its customers. However, occasionally, and for reasons beyond its control, human error or failures in computer systems may occur, so the quantity finally supplied by the supplier may differ from the initial order placed by the customer.
In the event that the product is not available after the order has been placed, MK FOOD & BEVERAGES, SLU will duly inform the Customer.
MK FOOD & BEVERAGES, SLU will not accept cancellations of orders through this website. To cancel an order, the customer must contact MK FOOD & BEVERAGES,SLU by email at: oficina@goodbiofoods.com .
The customer must clearly enter the delivery data, indicating the name, full address, contact person and telephone number.
MK FOOD & BEVERAGES, SLU undertakes to deliver the product in perfect condition to the address indicated by the Client. The address provided must allow the package to be received within normal business hours.
MK FOOD & BEVERAGES, SLU will not be held responsible for delivery errors when the address entered by the Client in the order form is incorrect or missing information.
From the delivery of the products, the risks of loss, deterioration or theft will be the responsibility of the Customer.
For in-stock products, the standard delivery time is 48-72 business hours from the order confirmation date. However, these are estimates, and MK FOOD & DEVERAGES, SLU will always strive to deliver as quickly as possible. If delays occur due to force majeure or logistical reasons, MK FOOD & DEVERAGES, SLU will inform customers as soon as it becomes aware of the situation. An order is considered delivered when the shipping company makes the product available to the customer, according to the tracking system used by the company.
Absence: If the Customer is not present at the time of delivery, the carrier will leave a notice. If after five (5) working days the Customer has not contacted the carrier, the products will be returned to the warehouses and the Customer must bear the return costs.
Loss: If the carrier notifies the lost package, a new shipment will be sent with the lost product ten (10) business days after notification, subject to availability. Otherwise, an equivalent product will be offered or a refund will be made.
The customer must check the good condition of the package in front of the carrier. If you detect any anomalies (dents, breaks, signs of having been opened), you must notify MK FOOD & BEVERAGES, SLU by email to oficina@goodbiofoods.com within twenty-four (24) hours of delivery.
MK FOOD & BEVERAGES, SLU will not replace any product in the order without prior consultation with the Customer.
If the Client cancels an order that has already been confirmed and it has already left the facilities of MK FOOD & BEVERAGES, SLU, or if the package is not accepted at the time of delivery, he/she must bear the transport and management costs generated.
No returns are accepted, except in the case of replacement of products that are not suitable for marketing, defective or that do not correspond to the order. In these cases, MK FOOD & BEVERAGES, SLU will collect the products and replace them with others that meet the agreed conditions.
To manage returns, Customer must report the incident by email to oficina@goodbiofoods.com within twenty-four (24) hours of delivery.
The customer will only be able to pay for orders through this website using the following options:
Debit or credit card (virtual POS): VISA, MASTERCARD and AMERICAN EXPRESS are accepted. You will need to fill out a form with the cardholder’s name, card type, expiration date, and security code.
Bizum: Fast and secure payment through the Bizum system, linked to the purchase process.
If any clause of these General Terms and Conditions of Sale is declared null and void, the remaining clauses shall remain valid and shall be interpreted taking into account the will of the parties and the purpose of the conditions.
MK FOOD & BEVERAGES, SLU may not exercise any right or power conferred herein, which shall not imply a waiver thereof, unless there is an express acknowledgment or prescription of the corresponding action.
These general terms and conditions of sale are governed by Spanish law. For any dispute arising from this contract, both parties expressly submit to the courts and tribunals of Lleida, waiving their own jurisdiction if it is different.
